I would think that it is very hard to get "discrete" video on a phone, or any camera that isn't designed to be hidden in some way. You're either pointing the camera at the person or you aren't.
The last photo is very odd. No movement to the whip (movement is distorted on crappy camera phones, as you see in the other images) so it isn't moving to strike the horse at that instant.
I personally would be yelling at the person to get the hell off my horse, not videotaping or otherwise recording the alleged horrible ride. What good do the images do anyways?
Color me skeptical, I suppose.

It's generally not too difficult to make it look like you're just txt'ing someone, though, instead of taking pictures.
Hold it at an angle as if txt'ing. When person isn't looking, flick the wrist a few degrees, snap a picture, and flick the wrist back.

But that said, I wouldn't be surprised if he didn't care. Lots of people take pictures of their horses being trained. Face it, we're horse people, we love our horses, we love pictures of our horses. I've taken pictures of several trainers on my horses over the years.
Now, I never had a trainer whose methods I disagreed with, but this guy probably doesn't think anything is wrong with his own methods, either.

My trainer allows me to videotape my lesson as well. I agree. He probably thought his training method was okay and was trying to "help" you. It's too bad your horse had to experience this kind of training.

I am glad that you kicked the trainer off your horse and property, but looking at your other thread about the horse, I would be happier - if you threw the tie down off your property too.
