The conditions described on the ticket say it was light out, dry, with moderate traffic. Anyone think I'd have any chance? Everyone is telling me to fight it....
If you go to court and ask to take the driving class I think it'll knock the points off. You can only do that once though.

Farm, a better thing to do would be for her to take the safe driving course voluntarily before she goes to court. I know it made all the difference in the world to the judge when I took it prior to my court appearance after having an at-fault accident. He said it showed a willingness to make certain I was never in that sort of situation again. Plus, my good driving record previous to the accident didn't hurt.

She doesn't need to go to court anyway unless she's planning to try and fight the ticket, but the safe driving course points are automatically added to your DMV record so will offset at least part of the points she might get.

I think it would be silly to not at least try and talk yourself out of a ticket if the opportunity arises and the reason for the stop is ridiculous. My first vehicle was red, bright red. It is true, I can testify to this...they pull over red vehicles far more than any other color. I mean, I was pulled over for making a CA stop at a 4-way in the middle of absolute nowhere w a clear 360 view..the kind of road you pray you don't run out of gas on...b/c there is no gas station for a loooong ways and there are few if any cars as measured over hours. Yeah, I tried talking my way out of that...like "you have got to be kidding me?" I got out of it, but that wasn't the first time I was pulled over for a really insane reason, nor was it the last.

Well I'm glad someone understands...if there's a chance to get out of the ticket, why not try? I wasn't going to fight it, but the officer messed up. I can prove I wasn't using my phone at 1am =P (12 hrs after actual incident)

You were on the phone at the time of the stop, so it's a valid ticket.
Just found out where I live, if there's error in the officers part on the actual ticket it's dropped immediately Happened to a friend.
