Protection order against abuse..

Ok Person A had this against Person B which was tempory but then since then had a court. HE can not have any Direct or indirect contact with Person A. This order is good until 8/24/2014......

Under section D "The defendant is Prohibited from, repeatedly and with out reasonable couse, stalking or following the plaintiff"
Under section E "The defendant is Prohibited from, repeatedly and with out reasonable couse, being at or in the vicinty of the planiniffs home,school, buisness or Place of empyolyment"

So here something I do not understand here. Person B came into walmart and hanging around and left with out buying anything. Also Person A hears he coming back to work on Monday same shift and working same place which means Person A will have to speak to him and deal with him. So walmart going to force the issues and have them work together? I am for one Peed off about this.

When Person B was hanging around Person A department the cops said they can not do anything because it's a public place.... Walmart is not a public place it's a store on private propety and he should not be able to shop there when Person A working. So what reasonable course for him to be around? most of all he been coming to the store a few times not buying nothing. Hell coming to Person A work place to shop not a good reason as you have other stores around the area like hanafords etc?

So too the reply that Person A got from the police what's the point in having a Protection order against someone when you your not going to enforce the papers. Person B even said at the court walmart policey that they can not having Person B working when the order is active... yet he is returning to work?

We live in Maine and if any one has experiance with this give their 2 cents it would be great.

I just can't understand how the police can not act on this other been lazy? I mean I found 3 links to a news sites cops called at Walmart to arrest the defendant because he at the work place with no course. (different state mind you)

If it was signed and officially stamped by a judge...its a court order everyone has to abide by it!
However, since they were both already employed at the same place..person who is under protection should check with a lawyer to see the rights in the state.

These are questions for the courts and State's Attorney, not for random people on a horse BB.

Actually, nothing you've posted has anything to do with the price of fish either. However, you're asking people about protective orders who AREN'T versed in the laws concerning them.

I'd never go to an attorney's BB and ask them about horses, so what makes you think a bunch of horse owners are going to know the ins and outs of your particular state's laws?

You don't need to save up for a lawyer. What is a lawyer going to do? If you already have the protective order, contact the courts and your local State Attorney's Office.

Kinda funny I tend to see people asking something non horse related.... I mean I am in the general off topic? I will ask what I want on here unless the admins state this rules been broken.

I am seeking some sort of advice or tips on the matter who could FUNNY enough have a trade in law? So really why are you posting in a thread that has no interest other than been snotty about it?

So if you have not got any positive then don't say anything.

Person A needs to take the court order into the Manager at WAlmart. And DEMAND that they do something. Problem is that their decision may be that Person A no longer has a job. Also, since court order states "without reasonable cause" that probably excludes employment. Since they are both employed at the same place and in the same department....well....Person A is probably SOL at getting the order enforced. That could also be why the police didn't enforce....

I can only suggest to consult the lawyer. Often 1st consultation is free. I don't know how the court order can be accomplished if both people work in the same place without firing one of them that is up to employer (which I assume is the case here?). In any case best luck!

OP check with the adult abuse department in the court jurisdiction where the Ex Parte was ordered..these orders are not taken lightly by the courts and if it is in full affect already...then it has gone beyond the he said..she said phase and has become an actual court order. It can be a felony to go against such an order..just not sure how the same employer plays a roll at all. The adult abuse department can guide you and even perhaps give you a list of attorneys near you who work on a sliding scale basis. Best wishes to you & the person you are trying to assist.
