Possible Unwanted Breeding info needed

Hello everyone. I have a question pertaining to Stallion ownership in Texas.My husband and I have spent numerous hours and $$$'s putting together a really nice herd of QH and paint broodmares. We have 3 breeding age mares, 2 yearling mares and a weanling filly.Recently a neighbor behind us went to the local auction and purchased 2 unregistered very grade-conformationally incorrect stallions for $50 a peice! Needless to say our mares are now coming into heat.The stallion owner doesn't speak very good english so it is hard to communicate with him or his family. About a month ago one of the studs got in with our mares and then went through another of our fences into an adjoining hay field of one of our neighbors.The man came to our house and told us he was going across our property to get his stud back. We went out there to make sure the stud wasn't going to mess with our mares and watched as the man and his son proceeded to tear down our back fence and have their stud step back across it and then re-wired it back up!!. Now we are using our only round pen to keep 2 of our mares enclosed and away from this stallion as both are in heat. We have contacted our local sheriif's department and he advised us to build a taller fence since we had the most to lose if one of our mares gets bred.He said our only other option would be to take the man to civil court and see what happens. Our farrier was out saturday and we told them what was going on and she said, in Oklahoma, where she is from that there is a ''Stud Law'' that states all stallions have to be enclosed in a 6 ft. High sturdy fence to protect from unwanted mishaps. My husband and I have searched the interent all morning looking for some sort of Texas law that is similar but have found nothing. We were wondering if anyone on here might be able to help us out with advice or point us in the right direction. Thanks Veronica

Contact your local USDA office or an attorney.

It is my understanding that in Texas you are responsible for your stud. Both in containing him and to damage to others. Either to property or to mares. (I don't know the exact law though) Another law is that you can shoot any animal on your property that you feel you are in personal danger to. (and I would feel in danger to a loose stud on my property.) Now, if it was me, I would let that neighbor know of that law and let him know that if he doesn't keep his stud contained he will be shot. (Even if you don't own a gun, he doesn't have to know that.) I would also let him know that if he impregnated (s) any of your mares, or injures them in any way he will get the vet bills. He is also responsible for fixing your fence. (if he hasn't already done so.)

Calling the attorney general is a good idea. Or you can try to find a lawer that specializes in equine law.

THe way I have learned it was if it is his stallion, it's his problems. If His stallion gets away and breeds your mare, you can take him to court. (But don't go just by what I'm saying... ask an attorney) But I also think that he is responsible for your fence. He may be from somwhere else, but he should quickly learn some polite ettiquete by at least paying for the fence.

This might be an unusual question but who would get the foal if they were impregnated? I know that they would only be grade but would he be able to take the baby? I only have higher grade qh's not that grade horses aren't amazing as well I just know I would be upset if my mare got knocked up by some ignorant neighbour

That's all he sounds like is a ignorant neighbour, i'm sorry yes he might be from some where else but he has to follow laws, I really do agree with tx only if it's a reacurence and a last resort yes I would shoot, but......check if the land is owned by him or rented!!! There's a law for that too

It doesn't matter if he owns the land or not. If he owns the STALLION then he is responsible. The only way he might not be responsible would be if he was at a boarding facility. If it was a boarding facility then they BOTH may share in the responsibility.

As for who keeps the baby. The mare owner keeps the foal or else has it destroyed in utero. It is their decision/choice. If the baby is not destroyed, then the owner assumes the responsibility of the mare and her health regarding subsequent foal. If mare owner decides to keep foal and for whatever reason mare dies (say in giving birth) the stallion owner is NOT responsible at that time.

We actually had a mare of ours (at a boarding facility) get impregnated by a very high $$ stallion. (BO stallion) We decided to keep the baby, and the stallion owner filed a breeding report so we got a nice baby out of it. (They probably did that so we wouldn't get mad(er))

I have known people who have had ignorant stallion owners that have had to threaten to shoot because stallion went nuts on their property (and kept comming back to wreak havoc) but never had to do it myself. I am currently a stallion owner but fortunately my guy is VERY much the gentleman. We actually have the opposite problem. The mares break INTO the stallion pen to get to HIM!! (the hussies!! )
