Silver looks like a grade paint to me, the way he's built anyway/ as the other looks like a QH, but with grade horses you never really know for sure

Pintos can registered as pinto, there are pinto coloured horses without TB blood in them (which are paints), they also have QH in them too. Pintos are 'coloured' horses of any other breed.
As said above, with grade horses you just never know, I think all horses should be registered and passported :s

I wouldn't venture a guess on breed but Lucky sure is gorgeous!! They both look healthy and happy :)
