spotted draft/paint tobiano color?

This is my coming 3 year old spotted draft/paint cross. I have had her a couple of months now. When I got her she was listed as a black and white. However, she has a lot of lighter areas and most of the darker areas are not even really black, more like liver or dark brown. Maybe I need to wait until she sheds out for summer? If the lighter brown on her muzzle and other areas of her body remains lighter after she sheds, what color would she be considered? The white hair on her tail is straight and the black underneath is kinky. Poor baby.

Your mare is brown, not black.

Bad Ass Brown and white, for sure

Would she be considered a bay tobiano paint since the brown on her legs turns into black and the spots on her legs are black....her face, except muzzle seems black and her mane and tail are black?

No, she is a brown tobiano. Brown and bay are both agouti genes that restrict black in certain ways.
