When should a horse/picture/video be open to critique?

    I would think that sharing pictures of abused horses and properties would also be considered fair use so long as it was for the purposes of "criticism, comment, news reporting, teaching, scholarship, [or] research". U.S. Copyright Office - Fair Use Again, this is not legal advice. As for requiring links to the sources of photos, there have been so few issues here that I don't think it would make sense to require such a thing.

    Copyright law and issues of attribution aside, if anyone has any thoughts about the circumstances under which members should be able to share and comment on/critique pictures or videos of a horse that is not their own, please let us know.

    Good for you!

    I am not a photographer and it still bugs me. It is just wrong. If you want the photo buy it.

    If you want to show off the proofs from a show post a link.

    I like the draft, sounds good. If you post a questionable picture on any website, no matter the intention, you are agreeing for that picture to be made public and open to public scrutiny unless it is posted to a secure site where the public cannot view it. I think any picture or video posted on an non private site such as photobucket or youtube is fair game. Pretty much if it is not protected where someone cannot get to it, it is fair game. If you want to share private photos or ones that seem question able send them through email so only the parties meant to view them can...

    My problem comes in when the said photo or video is posted for no purpose but negativity, when there is no educational value or reason or positive value for the picture to be placed on the forum, then I think it should be in violation. Funny, cute, awe inspiring photos and videos are all positive, photos and videos of abuse and questionable practices have educational value if posted as such, but "look at this ugly horse" and such should not be allowed. I guess what I am saying is that most photos and videos should be open for comment as long as the intention of them being posted is mature and not childish or biased and derogatory.

    Oh and I think copyrighted works with the digital watermarks should not be allowed, that is stealing even if the picture is of your horse... unless of course you are the photographer...

    As a stallion owner and having my own website that expressly forbids the usage of my picture taken from my website I will not be happy with anyone randomly taking my pictures.. It IS undercopyright.

    I had to PAY big bucks to get those pictures and what it does when they are taken FROM the site is to not allow credit to the site owner or photographer.

    A link to a site is one thing........the actual picture removal is another ball game entirely.

    Spyder - that's what I thought about copyright protected -but from what Mike is saying it still falls under Fair Use, which I'm not sure I quite agree with.

    Not completely. Just TRY taking a picture from a professional photographer for critique and see just how far fair use gets you after you pay court costs.

    Edit to add. I have an agreement with the photographer of my pictures so what is fair about just swiping pictures that I am obligated to protect also.

    I have already gone to the legal departments of various sites over this and won every time.

    Is there a way someone can claim that the negativity caused them a loss in revenue because of what was said about stallions (or whatever) or are critique's pretty much fair game for any horse posted online.
