Horse legal ownership Microchipped
I'm new here but I am in need of whatever sort of helpful information anyone is willing to share, be it good or bad news to myself.
I met a Gentleman that is traveling across the USA on horseback for various diseases (Cowboy for a Cure). When I met him he was quite the gentleman but has since turned into an evil man that only calls me and leaves messages verbally abusing myself and friends. I gave him a place to sleep for 2 weeks, fed him, bought a bunch of alcohol for him (alcoholic type behavior), donated a leather duster, Todd Sloan saddle pad (because his horse was being ridden with a massive saddle sore, donated about 100 hours to him to assist with building a website, and much more... I was doing this for the causes not for him. Anyway we decided to loan him one of our horses in which has coggins and is also micro-chipped in my name. This was in order to give his other horse a break because of his saddle sore. I had my farrier come out to check his horse out and he had told me his opinion in that his horse with the saddle sore also had ringbone.
So at one point I did mention donating my horse to the cause, possibly even in text message, I don't remember, I have PTSD, OCD, and Chronic Pain and the meds I have to take do a number to my memory. About 2 days after I said those things is when he began to verbally abuse me over the phone in which I saved every message he ever left me. He also would say stuff like "Are you off your meds?" even though he claims to ride for the same disease in which he pokes fun of that I suffer from (PTSD). I decided I did not want to donate my horse to him because of numerous things that had taken place. He even took our family off the list of thank you's on the website even though we gave him so much. What started all of the friction was the fact that I had full access to much of Cowboy for a Cure web stuff like the paypal site and I began to question how the funds were being allocated from the donations. I guess they didn't like my questions so they decided to kick me off the team, which didn't really bother me because I would not want to be associated with the things he does only the things he rides for.
Sorry if I'm all over the place on this... My meds make it a little difficult to keep on track.
Prior to myself, my husband and Johnny driving to Grants, NM. We had a mutual friend that picked up a pony for me in Grants and told me I could make payments to him for the pony. Johnny had said that he would pay for the coggins, farrier services, gasoline, and health certificate which added up to about 800. and he only gave us 20... This started an argument between myself and my husband because I had told him that Johnny would pay us, and he didn't, and I guess my husband is a better judge of character because he said we will never see the money and his was mostly right about that. My husband always tells me I give people the benefit of the doubt way to fast... I think he is right.
So later on after I questioned the funds and stuff he agreed to pay back the mutual friend in which is no longer mutual, its just Johnny's friend... Anyway he claimed he would pay for the pony to pay us back. Now remember this entire time he had my horse.
I have asked for my horse back and contacted my lawyer, in which has contacted Johnny and gave him until Tuesday to send him proof of ownership.
My horse is Micro-Chipped and in the AVID system, his Coggins is in my name and all Vet bills as well, I have never signed anything stating that Johnny has ownership of my horse although he may have some old text messages of me saying I may donate him to the cause. He left my horse was some people in Oklahoma (they seem like good people), and Johnny has said that if I want my horse I need to pay them the 23. a day for board, I asked for proof that he pays that, and so has my lawyer...
So, here is my question..
Can he actually end up with my baby? Is an old text message enough for ownership? Am I really required to pay this bill for 43 days of board even though I wasn't even aware my horse was left behind until 3 days ago? I would have picked him up immediately had I known he was just left somewhere. There is an old post from Nevada Department of Ag. asking Johnny why he abandoned a mule there with no one to care for it AT ALL at some fairgrounds. So I am grateful that he is being taken care of even though I do not believe I am the one that should be charged for it.
