Angry A problem with a consignment store that closed

I took a nice Albion dressage saddle to a consignment store in Nov 2009 I finally sold in Oct of 2010. I never received my money for it. The business has closed and I tried to take the person to small claims and they packed up and moved. I am owed $1000. Does anyone have a suggestion to help me find this person? I only want my money.

Geesh! That's terrible!

I'm sorry....but you may be out of luck.

Unless your consignment agreement specifically states that your item (the saddle) may NOT be considered an asset of the business (the store)....your item/money may have been garnished to pay creditors when the store went out of business.

(Sadly, I know this from experience -I never was able to track down the person who owned the store.)

If you can find the owner...you may be able to bring a case - especially if the owner was a sole proprietor. Otherwise - any debts were probably considered "settled" at the time the business closed and you are too late.

Carole, not trying to offend, but why did you wait for almost 2 years till they closed? If they didn't pay you in a month after it was sold you should of just talk to them and if no money take it to the court. Unless you can trace the owner of the business I'm not sure how to get your money back - I'd say talk to the lawyer.

Thanks for the response guys. I did try to take her to court in early 2011 and she didn't show up. I paid for a court summons and the police couldn't give it to her because she had moved away in a hurry. It just still bugs me that some people can sleep at night when they steal from innocent people.

Carole, PM me her name and where she was at when this happened, and the name of the store too and location.

I will dig around and see if I can find out anything.

Also, what type of horses was she into?

Horses make me a better person.
