Ethical and legal are two different things.

I can not really answer the legal question. Though I do not understand, even slightly, why someone would let a stud leave their property with out his papers. If you want to sell a horse with out its papers (not sure why) then geld it first.

I assume the people with papers sold the horse cheaply with out papers and expected more money if the papers went with the horse, is that the case?

Call the appaloosa horse club and ask them what they think you should do in this situation.

I honestly don't know what the case was when the guy sold him. All I know is that my FIL didn't get the papers when he bought him.

Also, is it common to leave a horse intact when he is a cryptorchid? The horse is a cryptorchid so I'm guessing that is why the guy left him a stud...

Oh, and I did contact the ApHC but never really got an answer just the run around.

    What did you ask them?

It's not the run around if you do not have a bill of sale from the owner on the registration papers. The club will see you as simply snooping. They have no proof you own the horse.

If he's crypt - cut him. The trait passes along.

I explained to them that I got this horse from my FIL who had bought it from the guy but never got papers from him. So I was wondering if it was possible to his papers. So they originally told me no but then I told them the horse was in my possession and I could send them pictures of him if they wanted.

I just don't really know how to go about getting his papers. Does anyone have access to the ApHC? I can give you the guy who has the papers name if you can look anything up for me.

What do you want looked up?

If you have the name of the person who has the papers what are you going to look up?

The appy clue requires a paper trail. They are not going to just give you duplicate papers because you call and give them a sob story.

I was telling you to ask them what they felt should be done about money being demanded for papers. But it is clear that this must not have really happened you were just asking ahead.

Instead of assuming drama, why not call the person who your FIL got the horse from and ask about the horses papers?

    And yes, Geld him. Now!

If you geld him, and he has appy characteristics you can get him hardship papers.

If the horse was sold without papers, then yes, the previous owner can request a fee in order for the current owner to get them.

If the horse was sold to your FIL with the express stipulation that the reason he was getting the horse for such a low price was because he came without his papers, then getting them will cost you.

If you have no idea of the horse's registered name or his pedigree, you're out of luck trying to contact the breed registry.

What do you need his papers for, anyway? As a cryptorchid, he's likely infertile. Unless you're planning to show in breed shows with him, his registration papers aren't all that important.

Exactly. Because I can not imagine you would be wanting to breed him since you say he is a cyrpt.

He's actually got a colt on the ground now and a foal on the way. I did not breed him - I got him after all this was done.

I would like his papers as I would like to show him.

Geld him and get hardship papers then.

Your FIL felt it was OK to breed a crypt. Lovely.
