Purchased Horse and Seller Still Has Not Completed Her End of Contract
 
Back in July, I entered into a contract on a several thousand dollar horse with a local breeder. She told me that the mother and father were both registered. As part of the contract she agreed to register my horse, assume all veterinary care, ferrier care, and provide medical documents by the weaning time. I paid my horse off at the end of August, and he is now in my care. The seller has yet to provide copies of the parents registrations, copy of medical records, and registration. It is now December almost and I still do not have any of these documents. She keeps telling me that she has sent off my registration papers for my horse, and has been telling me this for months. I finally called the registrar of the organization, and they informed me that they have not received anything for my horse. I called the seller back to discuss registration concerns, and she said that she would check into it. She also told me that my horses mother is in fact not registered. I'm really at a point where I feel she has not fulfilled her end of the contract. I'm just not sure what to do.

do you have a written contract stating the horse can be registered ? that parents were registered? if so , take her to court, if you have emails from her take those also. you can sue for the entire amount, and probably have to return the horse, or sue for part of the money diff between what a grade and papered horse would sell for, get written quotes from breeders in the area.

This happens so much. If the dam was not registered, your horse won't be either.

I do have a signed purchased contract. It states that she will provide medical care up until weaning. However, she never gave me those. I know in the midst if my excitement over my new baby that I forgot to request them again. I refuse to giver my horse back because she is not taking care of the horses she has left. She is just a breeding mill for Gypsy Vanners, and is out for the money and cares little about the horses. I had to pay to have him vaccinated and have his feet trimmed because she didn't do that either.

Does the contract state that she was going to have the horse registered?

Yes it does say she will register my horse, but she didn't put a deadline on it by when she would do it. She keeps telling me that she sent his paperwork in, and that it can take months for the registration to go through. That however is not what the registrar of the organization told me this week, and also that she has received no paper work on my horse.

Ok, this is starting to make more sense now-so the horse in question is a Gyspy Vanner? That helps to explain the price. At what age did she wean? If it's a colt,is he still intact, or has he even dropped? Is he at a boarding facility or at your home? They may have rules about when he needs to be gelded, & that will be another expense. Do you have any pictures? There are some Gypsy owners here,..hope they see this thread. Can you edit the title to add Gypsy to it?
