I'm the kinda girl that would ring up and put this lady in her place, but you don't sound like me :) You've been given some great advice, I really hope things work out well for you.

In some states, verbal contracts do stand (CA is one of them I don't know about others). However it is also illegal to contract with a minor in pretty much the whole country, so any contract with a minor won't stand and can not be enforced. If your mom signed a contract, you are pretty much stuck.

I was a little confused on that. So if you hadn't gotten the contract back what would you have done? Bought the mini? I think there is more to this story as I did a search on the mini and it is on equine.com for 500.00 so 5.00 a week sounds suspect but I don't think it is worth 500.00 either.

Regardless when I give my word I live up to it so I would pay the 40.00 but I forget others word means little so I am usually the one getting burned. But because I know others do not do what they say I would have kept the pony for sale until the cash was in hand.

This is confusing as one minute it sounds like you are paying the mini owner 5.00 a week and then the next minute it sounds like your mom is paying for the mini in full and you are paying your mom 5.00 a week????

(quote from the contract)
So this is why it sounds like a contact was signed. This shouldn't be so hard to follow. No wonder the lady with the mini is confused

I would be rich if I could charge everyone who ever wasted my time!

So a contract was signed but unless that contract said specifically that you would have to pay a $40 fee if you backed out - then she would have no legal leg to stand on. Now if you were in possession of the mini she could take you to small claims to get either her money or the mini back. However - if she still has the mini- then you owe her nothing.

All I pay my psychiatrist is cost of feed and hay, and he'll listen to me any day!
