Hi, I board my horses at a large stable in FL. I have 9 horses, 7 of which are rescues. I fell in love with a black stallion thoroughbred who was dumped there by his owner sometime around April 2010. The horse is beautiful but the owner never visits or anything. About two months ago he developed a limp which rapidly got worse. The barn owner called his farrier to come and look at him and he said he had an abcess. The farrier has come seveal times since then but now says that the horse needs a vet. I am afraid it might be the start of something irrepairable. The barn owner has notified the owner many times but he seems to be in denial and does not respond. I think the barn owner has tried but since the horses owner has not paid him he is hesitant to go too far in to debt for this horse. I tried to contact the owner through a friend of a friend and he has still done nothing. I don't want to get the barn owner in trouble because he did try, but I am hours away from calling the authorities, any ideas or comments would be soooo appreciated. I forgot to tell you this owner "loved" this horse so much he refused us when we offered to buy him a few weeks ago unless I paid him 25K, said he could not part with him because he was sentimental. Just in case this forum is national, I am in Florida. He also has another retired race horse there, same treatment...BTW why the barn owner has not acted to take the horse I cannot say, and the owner owns something like 10 more race horses and he is a neurologist and probably makes big bucks.

Isn't there something in the boarding agreement that covers abandonment?

I'm not sure about florida laws but I would be worried the barn owner may be responsible. If the horse is on their property and under their care. As far as the owner not paying board, again not sure of FL law but I believe after so many months the BO can take ownership of the horse and sell it for money owed to them......

Not much help on the initial problem, just thoughts thrown your way....

The BO can file an Agister's Lien and take the horse for nonpayment of board.

In the meantime, he should be calling a vet for the animal. It's not the horse's fault he has an irresponsible, nonpaying owner.

Regardless, if the BO does file the proper legal paperwork and take possession of the horse, it has to be sold at a public sale, which means the highest bidder will get it.

The sale can be held on the farm premises, but it cannot in no way, shape, or form be a private sale or a giveaway. There are certain laws a BO has to follow when they file an Agister's Lien.

So if you're asking if somehow you could acquire the horse for little or nothing the answer is no, unless you're the highest bidder at the sale.

Call the vet and send them the bill. If the horse needs seen badly it shouldn't matter who is paying...as long as the horse is being seen. At the end of the day, the BO could get into trouble for having a horse needing medical attention and not providing it. Owner or no owner, the horse is in *HER* care. She should call...mail the bill. If it gets paid, wonderful...if it doesnt...now you have even more reason to sell the horse out from under him.

I think SR gave the best advice possible. If you call the authorities very possible the BO will be the one they go after. It all depends on laws in particular state.
