To me, this appears decently level ground standing on.

Take a straight-edge and place it across the wither highest point and rump highest point...
Measure the distance from back to bottom of that straight edge....depending upon that number could and would impact my making a claim of sway or not.
A article about sways and where it seems study has not been as good as some other ailments, but...the numbers and findings are spoken of.
A study at the University of Kentucky says 2 1/2" or more and you have a sway...

I see a stance of sore in a few of the pictures shared too....but can not say why or where from a still photo.
Swaybacks are often said not painful, but look bad to the observer.
Saddle fit can create pain issue so careful consideration and support for the animal is a must.
Exercising to strengthen weakened is important and can improve mobility and guess appearances.

Both. Nothing will change these conformation issues, but the horse could definitely use some work on its feet, its diet, and its exercise program to at least help improve what nature has given it. With the feet trimmed and balanced, an increase in essential amino acids, and some work that encourages using the hind end, lifting the ribcage, and lowering the neck, this horse could at least look less swayed and downhill, and be stronger for whatever job it has.

With the dip hes got I say hes got a bit of a sway back, I dont think hes all that hip high maybe just a tad and the way he's standing hes got really sore hooves so hes standing a bit spread out, so that dont help matters much either.

I actually dont have much information on her. Shes a 12 year old broodmare that mostly used for trail riding. I had just gone to look at potentially purchasing her and had never seen her without a saddle on prior to going to meet her, so I was a little bit shocked.

OK, just saying she's only 12 makes me lean into the Both camp. I agree she could use some groceries, some alfalfa would help bring up some topline and help fill in that dip behind her withers but I don't think you could totally fill in the dip. I also agree with the need for a good farrier but that's not as much a concern as her back, for me at least. If her price was right and she ticked all my other boxes, I might take a chance on her.
